All Your Latest Kavanaugh News

This story long ago jumped the shark and is now attempting to jump past Pluto.  Seeing the mainstream media in full blown hysteria is amusing if not edifying.

  1.  Kavanaugh is being taken to task for what was written in his high school yearbook.  Go here to read about it.  If I were ever nominated for a Supreme Court vacancy now I would definitely first shred my high school yearbook for 1975 to protect the innocent and the guilty, since stupid remarks at 18 are now deemed to have significance for that post.
  2. A far left history Professor is claiming that he can recall a conversation with Kavanaugh in his freshman year in which he denied being a virgin.  Go here and read all about it.  Sounds reasonable to me.  I am constantly recalling from my freshman year at college in 1975 random conversations I had with near strangers.
  3. Michael Avenatti, better known perhaps as “creepy porn lawyer”, the attorney who represents Stormy Daniels, hotly denies being the dupe of a 4Chan hoax and he really, really will be providing proof that Brett Kavanaugh and Mark Judge ran a secret conspiracy to have teenage girls gang-raped at house parties.  Go here for his sober response to the hoax claim.
  4. Surprise.  Deborah Ramirez of New Yorker fame does not want to testify tomorrow.  Go here to read about this truly shocking development.
  5. Mark Judge was tracked down by intrepid newshounds who gave us the important detail that his car had dirty clothes in it and a Superman Comics collection.  Go here to read this stop the presses blockbuster!  Once a nerd always a nerd?  I can empathize with that.

I have been unable to confirm that today it will be revealed that while in Kindergarten Kavanaugh would never take his nap and  liked to steal the cookies of a little girl who was scarred for life as a result.


A Time For Anger

The video of the interview of Judge Kavanaugh and his wife from yesterday.  My heart goes out to them.  Neither of them were political novices before this madness, and they knew the confirmation battle would be rough, but not, I am sure, in their wildest nightmares did they expect it to be this rough.  That they have two young daughters is the icing on this cake of misery they are being forced to eat in public.

Judge Kavanaugh is a man of enormous probity and a jurist of the first rank.  Throughout his life he has played by the rules and worked hard and brilliantly.  He is a man of sterling family life, without a hint of scandal, until the Democrats dug up false charges from two obviously disturbed women, claiming actions by him, actions occurring while they were drunk, and actions they have zero corroborative evidence to prove.  In normal times he would be confirmed 100-0.  However, these are not normal times.  We live in times of moral chaos where the worst among us are filled with a passionate intensity to enact agendas that would transform evil into good.  Thus the Democrats are seeking to destroy not only the life of Judge Kavanaugh, but also the lives of his wife and daughters.

In the face of that, I would suggest that the attitude of the Judge to the Committee on Thursday should be one of cold, controlled fury.  He has been put through hell by the Democrats, and not just by these spurious allegations.  They transformed his hearing into a circus, complete with evil clownish staged interruptions, with the Democrat Senators continually trying to delay the work of the Committee.  The Democrats have acted in bad faith throughout this process and are worthy of every ounce of contempt the Judge can muster.  He should tell the television audience that all of this results from the simple fact that the Democrats lost the Presidential election in 2016 and they have refused to accept that fact.  That this whole bad farce has nothing to do with him and everything to do with the fact that the Democrats will do anything, literally anything, to prevent a jurist chosen by Trump to sit on the Supreme Court, and this is the reason they are seeking to destroy him and his family.  I trust that Judge Kavanaugh is viewing intently the testimony given by a friend of his, Justice Clarence Thomas, twenty-seven years ago, when the Democrats attempted a similar scam:





Brett Kavanaugh Letter

Judge Brett Kavanaugh put the Senate Judiciary Committee on notice today that he has not yet begun to fight:

Dear Chairman Grassley and Ranking Member Feinstein:   When I testified in front of the Senate three weeks ago, I explained my belief that fair process is foundational to justice and to our democracy.
At that time, I sat before the Senate Judiciary Committee for more than 31 hours and answered questions under oath.  I then answered more questions at a confidential session.  The following week, I responded to more than 1,200 written questions, more than have been submitted to all previous Supreme Court nominees combined.
Only after that exhaustive process was complete did I learn, through the news media, about a 36year-old allegation from high school that had been asserted months earlier and withheld from me throughout the hearing process.  First it was an anonymous allegation that I categorically and unequivocally denied.  Soon after the accuser was identified, I repeated my denial on the record and made clear that I wished to appear before the Committee.  I then repeated my denial to Committee investigators—under criminal penalties for false statements.  All of the witnesses identified by Dr. Ford as being present at the party she describes are on the record to the Committee saying they have no recollection of any such party happening.  I asked to testify before the Committee again under oath as soon as possible, so that both Dr. Ford and I could both be heard.  I thank Chairman Grassley for scheduling that hearing for Thursday.
Last night, another false and uncorroborated accusation from 35 years ago was published.  Once again, those alleged to have been witnesses to the event deny it ever happened.  There is now a frenzy to come up with something—anything—that will block this process and a vote on my confirmation from occurring. 
These are smears, pure and simple.  And they debase our public discourse.  But they are also a threat to any man or woman who wishes to serve our country.  Such grotesque and obvious character assassination—if allowed to succeed—will dissuade competent and good people of all political persuasions from service. 
As I told the Committee during my hearing, a federal judge must be independent, not swayed by public or political pressure.  That is the kind of judge I will always be.  I will not be intimidated into withdrawing from this process.  The coordinated effort to destroy my good name will not drive me out.  The vile threats of violence against my family will not drive me out.  The last minute character assassination will not succeed.
I have devoted my career to serving the public and the cause of justice, and particularly to promoting the equality and dignity of women.  Women from every phase of my life have come forward to attest to my character.  I am grateful to them.  I owe it to them, and to my family, to defend my integrity and my name.  I look forward to answering questions from the Senate on Thursday.

With a name like Kavanaugh I assumed that he would be a fighter, and I am glad that is the case.  To the smear merchants of the Democrat party destroying a man’s reputation is part and parcel of politics.  To a family man like Kavanaugh his good name is a pearl beyond price for his wife and kids.  He understands that, and his adversaries do not understand, yet, how hard a good man will fight for his family.

Update:  Kavanaugh is going to be interviewed on Fox during the 6:00 PM (CST) hour tonight.  Good.  He clearly understands that this has become a purely political fight.



Well, if one woman won’t kill the Kavanaugh nomination, try two:


The woman at the center of the story, Deborah Ramirez, who is fifty-three, attended Yale with Kavanaugh, where she studied sociology and psychology. Later, she spent years working for an organization that supports victims of domestic violence. The New Yorker contacted Ramirez after learning of her possible involvement in an incident involving Kavanaugh. The allegation was also conveyed to Democratic senators by a civil-rights lawyer. For Ramirez, the sudden attention has been unwelcome, and prompted difficult choices. She was at first hesitant to speak publicly, partly because her memories contained gaps because she had been drinking at the time of the alleged incident. In her initial conversations with The New Yorker, she was reluctant to characterize Kavanaugh’s role in the alleged incident with certainty. After six days of carefully assessing her memories and consulting with her attorney, Ramirez said that she felt confident enough of her recollections to say that she remembers Kavanaugh had exposed himself at a drunken dormitory party, thrust his penis in her face, and caused her to touch it without her consent as she pushed him away. Ramirez is now calling for the F.B.I. to investigate Kavanaugh’s role in the incident. “I would think an F.B.I. investigation would be warranted,” she said.

Ford v. Kavanaugh: Motion to Dismiss

As long time readers of this blog know, I am, for my sins no doubt, a lawyer.  During the last 36 years I have been involved in over ten thousand cases.  Many of them have had disputes as to facts.  The ascertainment of those facts is often the chief element in the ultimate decision in a case.  Christine Blasey Ford in her allegation against Brett Kavanaugh, Supreme Court nominee, has named four other individuals who were present at the alleged party.  Here are the responses by the named individuals:


CNN has learned that the committee has reached out to a longtime friend of Ford named Leland Ingham Keyser.

“I understand that you have been identified as an individual who was in attendance at a party that occurred circa 1982 described in a recent Washington Post article,” a committee staffer wrote Keyser earlier this week.

On Saturday night, her lawyer, Howard Walsh, released a statement to CNN and the Senate Judiciary Committee.

“Simply put,” Walsh said, “Ms. Keyser does not know Mr. Kavanaugh and she has no recollection of ever being at a party or gathering where he was present, with, or without, Dr. Ford.”

The lawyer acknowledged to CNN that Keyser is a lifelong friend of Ford’s.

Ford’s lawyer Debra Katz said in response to Keyser’s attorney’s statement that it makes sense that Keyser wouldn’t remember, because Ford has said she did not share her allegations “publicly or with anyone for years.”

“It’s not surprising that Ms Keyser has no recollection of the evening as they did not discuss it,” Katz said in a statement. “It’s also unremarkable that Ms. Keyser does not remember attending a specific gathering 30 years ago at which nothing of consequence happened to her. Dr. Ford of course will never forget this gathering because of what happened to her there.”

Keyser is the latest person alleged to be at the party to say she has no recollection of it.

White House spokesperson Kerri Kupec said of those who allegedly attended the party, “One week ago, Dr. Christine Ford claimed she was assaulted at a house party attended by four others. Since then, all four of these individuals have provided statements to the Senate Judiciary Committee denying any knowledge of the incident or even having attended such a party.”

The Washington Post reported late Saturday that it had talked to Keyser, who told the paper she believed Ford’s allegation.

Kavanaugh has vehemently denied the allegations, telling sources he was “flabbergasted” when he learned of them.

“This is a completely and totally false allegation,” he said after Ford came forward. “I have never done anything like what the accuser describes — to her or to anyone.”

In addition, two others have issued statements.

“I have no memory of this alleged incident,” said Mark Judge in a September 18 letter sent to the Senate Judiciary Committee. He said he did not recall the party and never saw Brett Kavanaugh act in the matter Ford describes.

In addition, Patrick J. Smyth issued a statement. “I understand that I have been identified by Dr. Christine Blasey Ford as the person she remembers as ‘PJ’ who supposedly was present at the party she described in her statements to the Washington Post,” Smyth said in his statement to the Senate Judiciary Committee. “I am issuing this statement today to make it clear to all involved that I have no knowledge of the party in question; nor do I have any knowledge of the allegations of improper conduct she has leveled against Brett Kavanaugh.”


Go here to read the rest.  If this were a legal proceeding, and if I were representing Judge Kavanaugh, I would be drafting two motions now:  one would be a motion to dismiss, and the second would be a motion for sanctions on the ground that the decades old allegations of Ms. Ford rest in thin  air and have no factual basis, and that the suit containing the allegations was completely meritless ab initio as a result.  I would be next contacting opposing counsel and advising him or her, diplomatically of course, that unless they dropped this waste of time litigation immediately, there would be be shear hell for Ms. Ford coming in the very near future.



But anonymously posted accusations ought to have no place in any prosecution. For this is both a dangerous kind of precedent and out of keeping with the spirit of our age.

U.S.—In a shocking, exclusive new revelation, sources have reported to us that Supreme Court nominee Brett Kavanaugh may have cheated while playing “The Floor is Lava” during his childhood.

Republicans have been trying to push Kavanaugh’s nomination through, but if these allegations turn out to be true, it’s clear that any senator with a shred of ethics left must vote “no” on his confirmation.

Multiple witnesses claim a 7-year-old Kavanaugh leaped from the couch to a pillow on the floor, but his foot clearly touched the carpet, rendering him “out.” However, the boy didn’t quit, but claimed he didn’t touch the carpet, saying “Nuh-uh!” when his friends pointed out the rules violation. “I totally didn’t!” he said. “My foot was like a million miles away from the lava. I’m still in, suckers!”

Go here to read the rest.  Of course the witnesses wish to be anonymous and will not be subject to questioning.  The shade of Henry VII, under whose reign the Star Chamber act of Parliament was passed in 1487, gives two thumbs up to this procedure.


Zina Bash and Leftist Insanity

One of the hilarious aspects of the concluded Kavanaugh hearings was the contention by very loosely wired Leftists on social media that Zina Bash, a former law clerk of Brett Kavanaugh, who sat behind him during the hearings, was giving a white power signal, which leftists contend is the “OK” hand sign.  The ancestry of Mrs. Bash consists of Mexicans and Jews who fled from the Holocaust.  The next day Mrs. Bash, obviously a woman of spirit, engaged in a little trolling.



My favorite comment about this exercise in Leftist insanity was made by a normal man, who remarked that he had noticed Zina Bash, who is a rather attractive lady, but he hadn’t been paying any attention to her hands.
