On July 25, 2020 Daniel Perry, an Army Sergeant and Uber driver, made the mistake of turning a corner in downtown Austin and finding himself among a mob of BLM rioters who began rocking and attacking his car.  Garrett Foster, an Air Force veteran, had been participating in the “mostly peaceful” BLM riots while carrying an AK 47, the weapon of choice for Soviet proxy forces during the Cold War.  He decided it would be a good idea to bring that AK 47 to the driver window of the car driven by Perry.  Perry then had to engage in split second mind reading to discern whether Foster was going to shoot him.  He decided that he didn’t like what he was seeing and he killed Foster with four shots from a 357 Magnum.  From his earlier interview that evening it struck me that Foster was something of a jerk who enjoyed intimidating people with his AK 47.  Well, play stupid games, win stupid prizes as they say.

In most parts of Texas this would have been a clear case of self defense, but Austin is a bit of bright blue in a sea of red.  The Soros funded District Attorney decided to bring murder charges against Perry.

The usual shenanigans went on with the Grand Jury.  The lead police detective on the case filed an affidavit in which he stated that the prosecutor had him omit over a hundred pages of exculpatory evidence before it was presented to the Grand Jury:

 

A jury convicted Perry last Friday.  Texas Governor Greg Abbott has indicated he will seek a pardon for Perry.  Incredibly, the Judge allowed in social media posts in which Perry railed against BLM rioters and theorized that he could kill one of them by claiming self defense as he drove on the job.  Allowing such irrelevant blowing off steam comments to be presented to a liberal Austin jury, when the facts of the case clearly indicated that Perry played no role in initiating the confrontation, basically had the Judge hanging a convict me sign about the neck of Perry.

This goes to show that you may be living in a very red state, but if you are attacked in a blue area of that state, an unscrupulous DA will do all in his power to put you away for decades on a trumped up murder charge.

Always point a gun in a safe direction.
Never point a gun at anything (or anyone !) unless you intend to use it.
Never assume a gun isn’t loaded or someone does not intend to shoot.

A NY County DA and jury will do the same to President Trump.

This is why the executive branch has pardon power.

Don’t give them more power than they have.
If any county DA would have done the same to Trump, they wouldn’t spend so much money on this.

Anybody else noticing how these guys consistently suppress evidence?

The thing they keep accusing the right of, but then can’t show any evidence?

While we keep getting proof of it, every time someone can even just look?

And the strawman award goes to Mehdi Hasan, for claiming to quote what absolutely no one on the right is saying. Foster wasn’t shot for carrying; he was shot for menacing, a perfectly logical and predictable outcome for a bully who thinks anyone he points his gun at is “too big a pussy” to respond.

Unfortunately, Texas law does not give full pardon power to the Governor. It has to go through the state parole board, which is appointed by the Governor but does not really answer to him. The board members are already under massive leftist/media pressure to refuse to recommend a pardon for Perry. The good news is, they don’t all live in Austin, so maybe they will come through without worrying about finding a mob on their front lawns.
The fact that exculpatory evidence appears to have been withheld from the Grand Jury might make a difference, but absent a pardon, Perry will probably have to await vindication in prison.
As they say, this story is “developing,” so by the time I post this the situation may have changed.

Is there any appeal process or is a pardon his only chance now?
And is there any hope of consequence to the DA fire suppressing evidence?

We saw the same sort of reasoning in the Rittenhouse case. Grosskreuz was viewed as only defending himself for pointing a gun at Kyle AFTER he had verbally expressed a desire to kill Kyle. But Kyle was said to be “brandishing” for maintaining possession of his gun as he tried to get to police after defending himself.
