The court-martial of this pompous Jackass, whose spy balloon business was kept alive with Chinese Communist money, is going to be amusing. Pass the popcorn. Here is just one statute that would be applicable:
8 USC 2387:
(a) Whoever, with intent to interfere with, impair, or influence the loyalty, morale, or discipline of the military or naval forces of the United States:
(1) advises, counsels, urges, or in any manner causes or attempts to cause insubordination, disloyalty, mutiny, or refusal of duty by any member of the military or naval forces of the United States; or
(2) distributes or attempts to distribute any written or printed matter which advises, counsels, or urges insubordination, disloyalty, mutiny, or refusal of duty by any member of the military or naval forces of the United States—
Shall be fined under this title or imprisoned not more than ten years, or both, and shall be ineligible for employment by the United States or any department or agency thereof, for the five years next following his conviction.
(b) For the purposes of this section, the term “military or naval forces of the United States” includes the Army of the United States, the Navy, Air Force, Marine Corps, Coast Guard, Navy Reserve, Marine Corps Reserve, and Coast Guard Reserve of the United States; and, when any merchant vessel is commissioned in the Navy or is in the service of the Army or the Navy, includes the master, officers, and crew of such vessel.
A Navy Captain is the equivalent of an Army full bird Colonel. Kelly knew precisely what he was doing and he deserves every bad thing that comes his way as a result.
I hope and pray that Senator / Captain Mark Kelly is prosecuted to the maximum extent permitted by the UCMJ. I truly hope that the Department of War follows through on this and hold him up as an example of subversion and attempted insurrection for all Americans to see. And yes, we must keep the Presidency in 2028 because otherwise the Democrat backlash will be unforgettable. Democrats like Mark Kelly must forever be removed from power.

As someone who served for 5 years during the Vietnam War (not in combat), we saw his like on a daily basis. Good news was that many like him were not sent in country to put our troops in greater danger. Bad news was that those of us in support units had to put up with petty fogging nonsense from his kind.
This strikes me as a pretty good case legally, but I’m concerned it may backfire politically the way prosecuting Trump did.
Mike S, I see your point, but they can’t just let this slide. Unlike the Trump prosecutions, these two maroons clearly and publicly violated Federal criminal law. There have to be consequences or military discipline will be severely damaged for a very long time.

@Penguin Fans: The voter rolls are completely penetrated with fraud in Maricopa, the most populous county, after years of registration fraud by Democrats.
I worked for years with two co-workers who bragged that they were illegals and yet voted in all the elections.
A citizens group after the 2020 election conducted a canvassing of voters in Maricopa Co.: they found at least 17,000 voters who had voted by mail in the election that used a non-existent residential address. How did they get a ballot? They found several thousand more that had moved out of state —or somewhere,—yet they had also purportedly voted by absentee ballot. I have a printout of the full report. The full numbers of non-addressed “voters” are about 50,000-70,000. Biden won AZ in 2020 by less than 12,000 votes.
I have a family member who moved out of state and she re-registered in the new residency state: she notified AZ she had moved and was no longer a lawful AZ voter. Yet someone voted for her in AZ in the 2020 election. She contacted the registrar of Maricopa County and requested to correct her voter status: they refused to do so unless she were to return to AZ in person and make an appointment with the registrar’s office, something she could not easily do. .
The prior Secretary of State was hard-left Katie Hobbs, now the Governor (see how that works?). The successor Sec of State is an even-harder-Left Adrian Fontes, who tried to register people to vote in 2024 without verification of citizenship. Charlie Kirk’s organization had a hand in limiting his efforts, a significant reason why Trump won AZ.
But the Democrats have their machine politics and they know how to print ballots.
Side note: Although many are calling for Kelly’s head on a platter, that is most unlikely to happen. One option that is open is to issue him a written reprimand that will go into his permanent file. While it theoretically can be appealed, the process itself is generally viewed as negative to the alleged offender.
Can they bust him down to swabbie? That ought to affect his retirement pension enough to make him regret his behavior.
