Prosecutors have a duty to turn over to the defense all exculpatory evidence in their possession.  That this was not done in this case warrants either a new trial, or summary dismissal with prejudice by the Court.

CAG, unlike our host, I did not routinely handle any criminal defense cases during my legal career, but I’m fairly sure that a plea agreement secured through illegally withholding exculpatory evidence from the defense is as worthless as any other contract secured by fraud. Now, the real question is whether the court will actually follow the law in this case and allow that plea to be withdrawn.

CAG and Frank: Here’s the problem. It should by now be apparent that the entire judicial system in D.C. is corrupted. Politics trumps evidence. Anyone accused by the government of supporting a “riot “ perceived as supporting Trump will automatically be found guilty by a D.C. jury, regardless of the evidence. The leftist Judges can then be counted on to impose a harsher sentence than any plea agreement. There are no fair trials in the District of Columbia in these cases. The solution, I don’t know. Perhaps a great enough public outrage, but I fail to see enough public interest.

JRP got it right. There are too many people with no interest in injustice as long as it doesn’t tough them. News flash; it eventually will, always has.
