One of the anxieties Elliot Richardson, Wm. Ruckleshaus, and Robert Bork had in October 1973 was that if Bork left the department along with Richardson and Ruckelshaus, it would trigger a statute which would allow Richard Nixon to appoint a White House lawyer as acting attorney-general, which would in turn trigger a mass walk out. Either Bork and Petersen misjudged the Department’s lawyers or the institutional culture of the Department was very different at that time. Getting information sub rosa to the opposition media is not that difficult. So, where are we hearing anything from the legal and police professionals in the Department protesting the conduct of their superiors and their minions?
