When I posted yesterday I gave the defense hell for its incompetence on day 3. On day 4 the prosecution reached legendary levels of incompetence. “Thou shalt not bear false witness.”
There ought to be a law against public employees – FBI, police, prosecutors – lying and cheating to falsely imprison American citizens, like Rittenhouse and 30 or 40 January 6 protestors. .
This nation’s metropolitan prosecutors’ offices have been doing a jim dandy job of persuading the public that they’re a danger to justice and order. And in Minneapolis and DC, they’ve got the bench conniving with them.
I think that both sides know that trials are now formalities; no member of a jury like this is actually going to make a judgment on the arguments presented. So why bother doing the work to make good arguments?
Whatever else is going on in this trial, I can assure you that attorneys do not have that attitude. Juries constantly surprise attorneys by their verdicts, and we are all keenly aware of that fact of our professional lives.
As a former prosecutor though, we are always looking for those types of answers to lock onto to point them out to the jury because some juror somewhere might be the type that will remember those blockbusters and not alll the testimony given by a witness in a 2 hour testimony. It was the mistake of someone who hasnt tried many cases I think.
