Here’s an interesting question, and one the Republicans in Congress will never get around to: how voluminous a federal penal code is actually beneficial? The ‘three felonies a day’ problem seems ever to relate to the machinations of federal prosecutors. Here’s another question: if the federal rules of criminal procedure allow for someone to be detained for months when the offense in question would be designated a petty misdemeanor in any sane jurisdiction, what are those rules of procedure actually worth?
