REBECCA GRASSL BRADLEY, J.(concurring).  Under the Wisconsin Constitution, all governmental power derives “from the consent of the governed” and government officials may act only within the confines of the authority the people give them. Wis. Const. art. I, § 1. The people of Wisconsin never consented to any elected official, much less an unelected cabinet secretary, having the power to create law, execute it, and enforce it. “[E]ver vigilant in averting the accumulation of power by one body——a grave threat to liberty——the people devised a diffusion of governmental powers” among three branches of government. Gabler v. Crime Victims Rights Bd., 2017 WI 67, ¶60, 376 Wis. 2d 147, 897 N.W.2d 384. Whenever any branch of government exceeds the boundaries of authority conferred by the people, it is the duty of the judicial branch to say so.

MADISON – The Wisconsin Supreme Court has struck down Gov. Tony Evers’ order shutting down daily life to limit the spread of coronavirus — marking the first time a statewide order of its kind has been knocked down by a court of last resort. 

The state’s highest court, which is controlled by conservatives, sided with Republican lawmakers Wednesday in a decision that curbed the Evers administration’s power to act unilaterally during public health emergencies. 

The 4-3 decision was written by four of the court’s conservatives – Chief Justice Patience Roggensack and Justices Rebecca Bradley, Daniel Kelly and Annette Ziegler.

The court’s fifth conservative, Brian Hagedorn, wrote a dissent joined by the court’s two liberals, Ann Walsh Bradley and Rebecca Dallet.

Courageous move by Wisconsin. Let us hope other states are not far behind. I like the statement: ” government officials may act only within the confines of the authority the people give them.”

Let us hope Trump strongly and publicly proclaims his desire that all states soon follow Wisconsin’s splendid example.

And, it appears former Navy pilot, Mike Garcia, flipped a Los Angeles Cong. seat to GOP.

Finally [Thank God!], FL and GA are opening and COVID-19 cases continue to decline despite leftwing hysterics about piles of dead bodies.

Watching the spin coming from the left wing media here in north Texas (which basically means the Dallas Morning News and all the over-the-air TV news departments) is educational. Now that the Governor has disobeyed their orders and begun the process of reopening, (and my wife and I have already had the pleasure of dining out twice with good friends), they have switched their efforts to foot-dragging, with story after story about how “many are concerned” about “opening too quickly”, and that “things cannot be like they were until mid-summer or later.” Of course, what this amounts to is congratulating themselves for having scared the living daylights out of the segment of the population that still have not learned to think for themselves. Sadly, that is a significant percentage, maybe even a slight majority. Even here. Sigh.

This crisis has shown me one thing. It is dangerous for anyone on the left to have political power. They must be defeated. The glee with which so many blue state governors have issued and reissued one series of arbitrary orders after another shows that they cannot be trusted with official power. I hope any number of them face recall efforts in their states for the harm they have done to so many. Carefully tailored orders are one thing. But that’s not what we’ve been seeing in far too many of our blue states.

Just as frightening is the number of people whose beliefs support those officials. We may jokingly call them “Karen” and such but in reality, millions believe themselves to be subjects, not citizens, kept, coddled, cared for and maintained by “Government.”
