Appellate courts which gin up grotesques like Roe v Wade, Romer v. Evans and Obergefell are quite capable of issuing decisions which rob those clauses of any practical implications. The courts take their cues from the law faculties, and faculties in our time fancy that free speech is for peers, and deplorables are not peers.
