There Will Always Be Law

If the authorities are too corrupt to enforce the law or too partisan or too frightened to do so, vigilance committees, formal and informal, will arise to do so.   This is rarely a good thing, but it is better than anarchy.  The main reason why we have a Second Amendment in this country:  an armed population is the final safeguard of liberty.

In the American South during the entire Reconstruction period, virtually every election was rigged in favor of Republican candidates, using various means both legal and illegal. That, all by itself, explains the violence of that period.

The Democrats during Reconstruction rigged elections through outright murder.

Yep. That, and ridiculous voting “tests” for blacks that professors at white universities couldn’t have passed.

The South had no truly free elections between the second Grant administration and the enforcement of the Voting Rights Act of 1965.

I have stories about how business was done in New York City during the time Carmine deSapio was president of the New York City Board of Elections. Elections administration is something if you average it out has always been done badly in this country.

It was in the immediate postwar period that the dam began springing leaks and blacks began to find their way onto the voter rolls, assisted by some federal legislation passed in 1960. It’s a reasonable extrapolation that w/o the Voting Rights Act the share of eligible blacks and eligible whites registered would have been about the same by 1980.

There’s a mess of injurious case law on apportionment, redistricting, elections administration, and race-and-voting which has been handed down since 1962. The courts meddle a great deal, but don’t protect us very much.

This is a fantasy.
