That They Are Endowed by Their Creator With Certain Unalienable Rights

 

The accused in Canadian criminal cases often ask for the rights they have heard about in countless American television shows.  Canadians do not really have rights as we understand them in this country.  Under the Constitution Americans have God given rights that are recognized by the government.  In Canada people have privileges given them by the government and which may be infringed or revoked by the government under certain circumstances.  In American history governments have infringed upon the rights of Americans, but the basic understanding of rights has meant that these infringements are bitterly contested and bitterly resented, with redress being sought at the ballot box or by less peaceful means if necessary.

 

Rights just are words on pieces of paper unless people are willing to fight, if necessary, to preserve them.

The Canadian Bill of Rights (which only dates back to 1960) does guarantee freedom of speech, religion and assembly. Canadian judges have done even more to destroy the meaning behind those terms than even US judges have, but technically Canadians are guaranteed these rights.

However the Canadian Emergency Powers act allows the government to ignore all of those rights. But that in turn is overrode by the Immigration and Refugee Protection Act, meaning that in a time of emergency the Canadian government can violate the rights of its own citizens but not illegal immigrants. Just in case you had any doubt about where their priorities were.
