The Rittenhouse Trial will be in session today, Kenosha County having traded Veterans Day as a court holiday for the day after Thanksgiving some years ago. Yesterday we learned that the ringtone on the Judge’s cellphone is Proud to be an American.

And incidentally the defense put Kyle Rittenhouse on the stand. A gutsy, or foolish move, Rittenhouse acquitted himself well, amazingly so for an eighteen year old, in spite of all the smarmy tricks of prosecutor Binger which earned him three rounds of severe judicial rebukes:
Over the years I have fenced with judges over judicial rulings during trials to make a record and sometimes to get the judge to reverse a ruling. If conducted in a good spirit and seasoned with humor, I have found most judges I appear in front of to be amenable to a bit of spirited back and forth, outside of the presence of a jury. That was not what prosecutor Binger was doing. He was deliberately violating court rulings in the case and attacking the fundamental right of a defendant to remain silent, and not to have his silence used against him at trial. He was doing this in front of the jury, perhaps to provoke a mistrial in a case he appears to be losing. This is despicable and he richly earned the ire of the Judge.

Don, is there a view among lawyers that denial of a motion for a directed verdict can be seen by the jury as a possible denial of the defendant’s innocence? If this is so can the motion be made outside of the jury’s hearing? Just curious.
The motion is always made outside of the jury’s presence. The jurors are unaware of it being made or denied.
What is the political background of this Binger? I just finished watching the three videos on this post and it seems to me he is playing to the cameras, possibly for 2 reasons. First, he knows that the judge has ruled the ‘evidence’ he is trying to introduce is inadmissible, so it would seem he is playing to a ‘court of public opinion’ that has already judged Rittenhouse guilty. Second, it appears that he is trying to make that ‘court of public opinion’ think that the judge is persecuting him. I have the sense that he is throwing red meat to the Woke for reasons that have nothing to do with this trial.
Supposedly, Binger is a shirt-tail relation of the mayor. You have riots when politicians insist police stand down. The trial is some of the detritus of decisions made by said mayor.
