Kyle Rittenhouse is that rarity in a criminal prosecution, a completely innocent man. Judge Bruce Schroeder is what every Judge should be: impartial, wise and a master of the law. Prosecutor Thomas Binger is what every non-attorney hates about attorneys: sophistical, win at all costs and mendacious. Rittenhouse is lucky that he got a good Judge by the luck of the draw and that his well wishers provided him the resources to have private counsel who are not completely incompetent. Too many people in our society receive only a fun house mirror form of justice, railroaded by unscrupulous prosecutors before bored, often rather uncaring, judges, often former prosecutors themselves who sometimes forget which side of the Bench they are now on, and with defense attorneys who are simply not competent. This case spells out much that is wrong in what we risibly call our criminal justice system. Most defendants in criminal cases are guilty, in my opinion, unlike Rittenhouse, but too often they are convicted by the State in trials that are anything but fair. This lack of fairness causes defendants to agree to one sided plea bargains in cases that should be eminently winnable if fought out in trial. And that is the end of my defense attorney for 39 years rant.

Come to think of it, what’s changed?
In effect, the entire nation is threatened by a lynch mob unless the defendant is convicted. Can a jury of normal citizens handle this enormous pressure? More than this young man’s freedom hangs in the balance. Our entire criminal justice system is on trial. Will it survive or will juries simply become formalities on the path to imprisonment of those who offend the “woke” leftists who dominate the media and our government? We shall see.
