Kyle Rittenhouse Trial-Day 8

Yesterday the State rested.  To my surprise the defense did not move for a directed verdict on the major charges.  The curfew charge was dismissed.  The defense then began their case with witnesses who testified to the chaos caused by the riot and Rosenbaum’s, the man who made the mistake of attacking Kyle Rittenhouse, violent and aggressive stance.  I thought the witnesses were quite effective, especially photographer Nathan DeBruin, who testified that the prosecutors attempted to get him to change his testimony prior to the trial.  Another good day for the defense and another bad day for the prosecution.

Here are recaps from yesterday:

Go here for a live feed of the trial.  The trial should be resuming at 9:00 AM CT.

Update:

I have been practicing law for 39 years.  I have never seen a Judge this angry:

The prosecutor is either a clueless jackass or he is deliberately trying to provoke a mistrial.

Lies are truth
Truth are lies
Hypocrisy is a virtue.

Twain, “If you don’t read the papers, you are uninformed. If you read them, you are misinformed.”

Orwell, “I read reports in newspapers things that did not contain the modicum of truth contained in the common lie.”

Act accordingly.

Although extremely unlikely to happen, what strategy could possibly be behind not asking for a directed verdict on all charges at the conclusion of the prosecution case?Hope they don’t snatch defeat from the jaws of victory by putting this kid on the witness stand. Already a major mistake in implying they would in opening.

I’m seeing conflicting reports on whether a request for a directed verdict was not made, or whether it was made and denied by the judge.

The effect would seem to be the same either way, and this case will likely come down to whether the open intimidation of the jury has the desired effect.

With how feeble the prosecution’s case was, the intimidation is probably what they were been banking on all along.

Suspect the publicity and media has much to do with that. They’re letting it play out. I just hope the jury doesn’t act stupidly.

I don’t know what lesser charges are available for the jury, but I’d think that if the jury hates Rittenhouse they’ll try to get him for something. The defense must think they need to be sure the jury likes him. I hope they’re not being way too clever.
