Sotomayor and Kagan come from the class of liberals who view the law as a weapon, but understand the importance of maintaining plausible deniability. “It’s not that I wanted to make that decision, I was just following the law. It’s just a coincidence that I never rule in a way that would favor conservatives.” This means paying attention to procedure.
The new generation, exemplified as Jackson, is so committed to the cause that they want everything to be an immediate victory. So they feel free to ignore the law, logic, even the basic meaning of words, if it can be used to justify a win.
