So now attorneys are to be suspended for statements that do not pan out in court? That would place every losing attorney in every piece of litigation potentially at risk. Note this is being done before the disciplinary investigation is even completed. Guiliani is of course being targeted not for statements that turned out to be unproven or false, but because he was an advocate for Orange Man Bad.  Guliani is retired from the law, so as a practical matter this sanction has limited meaning for him. The real target of course is all other attorneys, and a warning that if they represent clients disfavored by the powers that be, their licenses are at risk. The glory of the legal profession hitherto was to provide zealous advocacy for clients, no matter how unpopular they might be with the powerful. Apparently this is no longer the case. This sorry debacle demonstrates the validity of the maxim that everything the Left touches it corrupts and debases.

The thing that really bothers me about this story is this: yes, the Giuliani team cited video evidence of ballot manipulation that examination of the full video disproved. If this suspension is based on that incident then it means that a lead attorney of a team is required to personally review every scrap of evidence, every long hour of video coverage. Moreover, that video disproved Giuliani’s thesis only because the people in the video were able to provide a reasonable commentary as to what had happened, a commentary that under deadline pressures Giuliani probably did not have access when he made his statements.
This is another example of what I call “The Mission Impossible opening scene fallacy”: we are expected to have near-perfect information during decision making despite the fact that we usually don’t. We saw this in the criticism of the Anglo-American intelligence gathering and analysis of Saddam’s weapons of mass destruction. It’s another example of letting the children mix with the adults in the room.
