I would say I am shocked, but this is the DC Circuit where Democrat appointees are in the majority, and this is the year of lunacy called 2020:
A federal appeals court said Thursday it plans to review a decision ordering the dismissal of the Justice Department’s case against former Trump national security adviser Michael Flynn.
The action by the U.S. Circuit Court of Appeals for the District of Columbia is likely to prolong the fight over Flynn’s fate and represents yet another dramatic development in a case that has taken unexpected twists and turns over the last year and turned Flynn into something of a cause celebre for President Donald Trump and his supporters.
The court set arguments for Aug. 11. It did not offer an explanation for its decision in a brief order posted online.

They do this because (1) they’re not very professional and (2) they fancy they’ll get away with it. The President and Congress have had ample opportunity over more than 60 years to discipline the judiciary with two expedients: withdrawing federal marshals from particular district, refusing to appropriate funds for particular districts and circuits, redefining the boundaries of jurisdictions to consist of one square yard in the middle of a street to be named, and paying federal judges once a year in potatoes. While we’re at it, the law professoriate is chock a block with frauds.
The politicization of the judiciary is a national disgrace. If they insist on behaving like partisan actors, then they should have to run for office.
There is no legal or illegal in America. There is what you can get away with and what you can’t.
It has come to a pretty pass when some Federal Courts have become the enemies of Justice.
