Role of Government
So we’ve been discussing the proper role of the state on this blog recently, particularly as it relates to the legalization of marijuana. This discussion, in all of its unfortunate snarkiness and nastiness (to which I freely admit having contributed, not that I’m proud of it) is really a discussion on the proper role of the state.
I think it is rather uncontroversial to assert that America was basically founded upon the Lockean social contract theory. We begin with the proposition that everyone has basic natural rights: to life, liberty, and property. In a hypothetical scenario in which there is no coercive authority (the state/government), we must also act as our own judge, jury and executioner. In this anarchic situation, our rights to life, liberty and property are unsecured. In order to secure them, we collectively renounce our right to be our own personal government and transfer that right to a government we establish by contract. Our property – life, liberty and estate – is more valuable and necessary for life than our “right” to do as we please, when we please, to whomever we please.
The terms of the contract are rather simple. They are stated very simply in the Declaration of Independence. Governments exist to protect our natural rights. They don’t exist to make us “better people” – that’s what the Church is for. They don’t exist in order to achieve “social justice” – that is what private charity and free markets are for. The individual American states were founded by people of like-minds who wanted to establish communities that reflected their religious values – Pennsylvania for Quakers, Maryland for Catholics, and so on. The Constitution was created by the states mostly for the purposes of common security.
Government is not a positive good. It is an evil necessary to prevent the greater evils that would result from total anarchy. As such, it must be kept on the tightest of all possible leashes, which is why so many Americans demanded a Bill of Rights as a condition for the ratification of the Constitution. If men in a state of anarchy would be evil, they don’t suddenly become angels because we give them titles, badges, and offices. The evil in our hearts is the evil in their hearts, and the greater the scope and depth of the powers we give to governments, the greater potential for evil we establish.

The Federal Trade Commission has produced a staff discussion draft which may be read here, filled with bad ideas to prop up the dead tree media. Among the worst of the ideas is what boils down to government money being used to subsidize the fish wrapper industry:
Proposals for Increased Government Subsidies, Indirect and Direct A variety of proposals have emerged to allow further government support for journalism through either indirect or direct means. Whatever the means, care must be taken to ensure that government support does not result in biased and politicized news coverage.
Increase Government Funding
Establish a “journalism” division of AmeriCorps. AmeriCorps is the federal program that places young people with nonprofits to get training and do public service work.87 According to proponents, this proposal would help to ensure that young people who love journalism will stay in the field. “It strikes us as a win-win; we get more journalists covering our communities, and young journalists have a chance to gain valuable experience – even at a time when the small dailies where they might have started are laying reporters off.”
There are many political fault lines that run through American society, perhaps more today than any point in recent history. We can all probably name a few of the ideological, cultural, and religious lines, but there is one in particular that I wish to explore with you today: divisions over whether or not, and to what extent, it is legitimate to resist the government. By resist, or rebel, I mean a refusal to comply with laws, though in the future it may mean something else entirely.
When “left” and “right” are set aside, what appears to separate the “mainstream” from “extremism” is the position they take on this vital question.
Naturally, in a country with revolutionary origins, whose founding document establishes the right of the people to overthrow governments that break their end of the social contract, talk of resistance or rebellion in general cannot be dismissed as insane, though some undoubtedly try to argue along those lines. There is also a broad political consensus in the mainstream that civil disobedience against overt racial injustice is legitimate; few Republicans these days have anything other than praise for the aging heroes of the Civil Rights movement of the 1960s.

Reagan warns us of how people such as six-time presidential Socialist Party candidate Norman Thomas, and many others, explained how to move their agenda of achieving a socialist state by a Foot-in-the-Door policy of socialized medicine. Which is eerily similar to what President Obama and the Democrats are doing, against the will of the people with their European socialized health care bill.
The so-called American conservative movement is not conservative in the sense that many of its proponents would suggest. In reality, American conservatism, in many ways seeks to preserve and reassert classical liberalism. In fact, the entirety of the American political spectrum is liberal in different ways and varying degrees—but it is unmistakably and manifestly liberal.
This should come as no surprise since many of the Founding Fathers were men of the Enlightenment and there is no more obvious case than that of Thomas Jefferson, the author of that quintessential Enlightenment masterpiece The Declaration of Independence. The philosophical paradigm by 1776 had already shifted—anthropology was evolving toward an increasingly false view of man and the natural law (because the philosophical concept of “nature” was changing) was something different than that articulated by classical philosophers, which had been incorporated into the Christian tradition.
The American legal tradition seeking to adhere to the letter of the social contract, i.e. The Constitution of the United States of America, seems to have individual liberty at issue in every question of law. This, to be sure, is not something to be regarded as a problem in and of itself, insofar as the operative definition of liberty is not philosophically false and the norms of justice, in the classical sense, are not contradicted.
To the learned mind, it is patently clear that the predominant philosophical paradigm, anthropological assumptions on human nature, concept of the nation-state, view of society, of freedom, of responsibility, and so forth found in the Western world is undoubtedly borne of Enlightenment thinking. The United States is most certainly no exception. In America, across the political spectrum, there is a dubious philosophical premise, that of an abstract ideal of autonomy, which, no matter how admirable or attractive it may seem, is radically incomplete. Hattip to Ed Morrissey at Hot Air. As someone who received an undergraduate degree in the teaching of social studies, I am never very surprised when a school administration decides to engage in an act of public stupidity, however, this incident is in a class all by itself.
A second grade student at the Maxham Elementary School in Taunton, People’s Republic of Massachusetts, was sent home from school after drawing a picture of Jesus on the cross. The student made the drawing in response to a class assignment that the students draw something that reminded them of Christmas. Apparently the student’s dullard teacher decided that the drawing of the cross was too violent. The school administration, in a move which hearkens back to the old Soviet Union placing dissidents in psych wards, decreed that not only would the child be sent home, but that he would have to undergo a psych evaluation.
